Panaché Terms of Service

These terms govern the use of the Shopify app "Panaché – Mixed Wine Cases" ("the app"), published by Alexandre KHEFIF-DERAIN, individual (registration in progress), 15 boulevard de Verdun, 59000 Lille, France ("we"), by any merchant who installs it on their Shopify store ("you"). By installing the app, you accept these terms.

1. The service

The app lets you sell wine by the case: choice of allowed sizes, bottle counting, messages on the storefront, blocking incomplete orders at checkout, product suggestions and statistics, depending on the chosen plan. What each plan includes is described in the app (Plan page) and on the App Store listing.

2. Plans, trial and billing

  • Paid plans are billed by Shopify, in US dollars, on your Shopify invoice, monthly or yearly as you choose. A 14-day free trial is offered on paid plans.
  • You can change plans or uninstall the app at any time from the Shopify admin. Billing follows Shopify's rules (proration, refunds); we don't grant refunds outside these rules, unless we made an error.
  • We may change prices; any change will be announced at least 30 days in advance and will only apply once you accept it in Shopify.

3. Your responsibilities

  • You set up the app (sizes, products in scope, messages) and check the result before turning it on for your customers; the app's test mode is there for that.
  • You remain solely responsible for your commercial offer, your prices, your messages to customers (including the benefit text you enter) and for complying with the rules that apply to selling alcoholic beverages.
  • You inform your customers of the data processing related to your store, including the processing done by the app (see the privacy policy and the data processing agreement).

4. Operation and availability

  • The checkout rule is designed never to block an order because of an app incident: if its configuration is missing or unreadable, orders go through normally.
  • The rule doesn't apply to point-of-sale sales (Shopify POS) or to the customers you exempt.
  • We do our best to keep the app available and working, without guaranteeing uninterrupted service. The services of Shopify, your theme or other apps are outside our control.
  • Statistics are provided for information; some measures (for example blocked orders) depend on your customers' consent and are minimum values.

5. Liability

To the extent permitted by law, our liability is limited to direct and proven damages, and capped at the amount paid for the app in the 12 months before the event giving rise to the claim. We are not liable for lost revenue, data or opportunities, or for the consequences of an unsuitable configuration.

6. Personal data

Data processing is described in the privacy policy (https://web-production-b025a.up.railway.app/legal/privacy?lang=en) and governed by the data processing agreement (https://web-production-b025a.up.railway.app/legal/dpa?lang=en), which is part of these terms.

7. Intellectual property

The app, its code, texts and graphics remain our property. You have a non-exclusive right of use, limited to your store and to the duration of the installation. Your settings and content remain yours; you can export them from the app.

8. End of use

You can uninstall the app at any time. We may suspend access in case of fraudulent use or use contrary to these terms, or stop the service with at least 30 days' notice. After uninstalling, your data is deleted as described in the privacy policy.

9. Changes to the terms

We may change these terms; the version in force is published at this address with its date. For any significant change, we will let you know at least 30 days in advance.

10. Governing law

These terms are governed by French law. Failing an amicable agreement, any dispute falls under the competent courts of Lille. Contact: support@getpanache.app.
